Nebraska CPAP Lawsuits Demand Cancer & Asthma Settlement

In 2021, Philips initiated a recall of several of its Continuous Positive Airway Pressure machines, prompting a wave of Nebraska CPAP cancer lawsuits.   The recall was a significant event in the respiratory care and sleep medicine fields, and stemmed from concerns related to sound abatement foam used in these devices.  Nebraska CPAP lawyers claim the sound abatement foam could potentially degrade and pose health risks to users.  Click here to view the product recall notice published by the U.S. Food and Drug Administration.

Sound Abatement Foam Degradation

Philips utilized a polyester-based polyurethane (PE-PUR) sound abatement foam in certain CPAP and BiPAP (Bi-Level Positive Airway Pressure) machines.  The primary function of this foam was to reduce the operating noise of the devices, ensuring a quieter environment conducive to sleep for the user.  However, Nebraska CPAP lawsuits claim that this PE-PUR foam could degrade into particles that might enter the device’s air pathway, entitling those who inhaled or ingested it to a settlement.

The degradation of the foam raised two primary concerns: the physical harm caused by inhaling or ingesting foam particles and the chemical toxicity from the potential release of harmful chemicals as the foam degraded.

Physical and Chemical Risks to NE CPAP Patients

Nebraska CPAP cancer lawyers argue the inhalation or ingestion of PE-PUR foam particles poses a direct physical risk to human health.  Physically, these particles can cause irritation to the respiratory tract, leading to symptoms such as coughing, chest pressure, and, in severe cases, acute respiratory distress.  Additionally, the particles could exacerbate underlying respiratory conditions such as asthma or obstructive pulmonary disease.

Chemically, as the foam degrades, it can release volatile organic compounds (VOCs) and other potentially hazardous chemicals.  These compounds pose a toxicity risk with both acute and chronic health effects, ranging from headache and dizziness to more severe liver and kidney damage or carcinogenic effects over prolonged exposure.

Scientific Analysis of Sleep Apnea Foam Degradation

The degradation of the PE-PUR foam in Philips CPAP machines involves complex chemical processes influenced by environmental factors such as temperature, humidity, and exposure to ozone.  High temperatures and humidity levels can accelerate foam degradation by breaking down its polymer chains, leading to physical crumbling and the release of VOCs.  Additionally, the use of ozone-based cleaning products can exacerbate this degradation process, despite ozone cleaners being popular for sanitizing CPAP equipment.

Nebraska CPAP lawsuits rely on various analytical techniques to identify and quantify the degradation products of PE-PUR foam.  Methods such as gas chromatography-mass spectrometry (GC-MS) and Fourier-transform infrared spectroscopy (FTIR) have been pivotal in identifying the chemical composition of emitted gases and particles, thereby understanding the potential health risks posed by these emissions.

SoClean CPAP Cleaning Solution Under Scrutiny

The Philips company has attempted to blame the SoClean cleaning solution for CPAP related injuries.  However, the defense has been met with skepticism by CPAP lawyers in Nebraska and across the United States.

The cleaning solution is separate and distinct from the foam particles suspected of causing cancer.  Moreover, even if the SoClean solution is hazardous, Philips knew it was being promoted for use on its devices and did not adequately warn users.  Therefore, Philips should remain liable in NE CPAP lawsuits.
